1. Acceptance of terms
By accessing or using giftwrapd.com ("the platform", "GiftWrapd"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.
These terms constitute a legal agreement between you and GiftWrapd. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance.
2. About GiftWrapd
GiftWrapd is an AI-powered gift discovery platform that provides personalised gift recommendations and connects users with personal shoppers via our Concierge service. We are currently in a pilot phase; some features may be limited or change during this period.
3. User tiers
Free tier
Anonymous users may perform up to 3 gift searches without creating an account. Search quality and results are provided on an "as is" basis.
Basic (free account)
Creating a free Basic account provides unlimited gift searches. By creating an account, you agree that your contact details (name, email, phone) may be used by GiftWrapd to contact you about relevant personal shopping services and platform updates. You may opt out at any time.
Concierge
The Concierge service connects you with our AI adviser and then matches you with a human personal shopper. During the current pilot, Concierge is provided free of charge. Post-pilot pricing will be clearly communicated in advance. GiftWrapd does not guarantee the availability of a personal shopper for every request.
4. User conduct
You agree not to:
- Use the platform for any unlawful purpose or in violation of any applicable laws
- Submit false, misleading, or fraudulent information
- Attempt to circumvent search limits by technical means
- Use the platform to spam, harass, or harm other users or personal shoppers
- Reverse engineer, copy, or scrape the platform's content or AI outputs at scale
- Use the platform in any way that could damage, disable, or impair its operation
5. AI-generated recommendations
Important: Gift recommendations are generated by artificial intelligence (powered by OpenAI's GPT-4o model). While we strive for accuracy, AI recommendations may occasionally be inaccurate, outdated, or not available at the suggested price. Always verify product details, availability and pricing directly with the retailer before purchasing.
GiftWrapd does not guarantee that any specific product recommended by our AI is available, in stock, or sold at the price indicated. Product information is provided for guidance only.
6. Affiliate links and advertising
GiftWrapd participates in affiliate programmes including Amazon Associates and Awin. When you click a product link and make a purchase, we may earn a commission at no additional cost to you. Affiliate links are clearly disclosed in our disclaimer.
Some products are displayed as "Sponsored" or "Featured" placements. These are paid advertisements and are clearly labelled. Sponsored placements do not influence our AI gift recommendations, which are generated independently.
7. Concierge and personal shoppers
Personal shoppers on the GiftWrapd platform are independent contractors, not employees of GiftWrapd. They operate under the GiftWrapd Shopper Agreement and have been identity-verified. However, GiftWrapd cannot guarantee the outcome of any shopping engagement.
GiftWrapd acts as an introducer between you and personal shoppers. Any commercial arrangement (payment for goods sourced by a shopper) is between you and the shopper, facilitated by the GiftWrapd platform.
8. Intellectual property
All content on giftwrapd.com — including text, design, logos, and AI-generated output displayed on the platform — is the property of GiftWrapd or our licensors. You may not reproduce, copy, distribute or create derivative works without our prior written consent.
The GiftWrapd name, logo and "GiftWrapd." mark are proprietary. Unauthorised use is prohibited.
9. Privacy
Your use of GiftWrapd is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the platform you acknowledge you have read and understood our Privacy Policy.
10. Disclaimer of warranties
GiftWrapd is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:
- The accuracy, completeness, or suitability of gift recommendations
- The availability or uninterrupted operation of the platform
- The quality or outcome of any Concierge session or personal shopping engagement
- The accuracy of any product information, prices, or availability
11. Limitation of liability
To the fullest extent permitted by applicable law, GiftWrapd shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or goodwill.
Our total liability to you for any claim arising from use of the platform shall not exceed the amount you have paid to GiftWrapd in the 12 months preceding the claim (or £100 if no payments have been made).
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Termination
We may suspend or terminate your account or access to the platform at any time, with or without notice, if we believe you have violated these terms. You may close your account at any time by contacting hello@giftwrapd.com.
13. Governing law
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
